Terms & Conditions & FAQs

This section is here to help you with issues surrounding the website and purchases. If you have a question that is not adequately answered here (or elsewhere on the website), please send us your question via the Contact page so that we may deal with your query.

The website is a showcase for Kate Daniels painting, past and present. It is designed to show you some of her best work over the past few years. From this site you may purchase both original works, cards & posters and you may also commission a unique work of art based on your photo (please see Copyright section below).

ORDERS

All orders for printed goods will be dispatched promptly upon receipt of cleared funds. Typically, this will be within 1 -2 working days, although during holiday periods this may be longer.

Unless otherwise stated, orders under the value of $50 will be sent by Standard Mail (Air Mail if overseas). A receipt of posting will be kept, and in the unlikely event that items go missing, a claim will be made by us against the carrier, and the item will be reshipped at no additional cost to the customer.

Although Postal carries quote guidelines on the deliver of items, we are all aware that some items take longer that other to be delivered. Your patience and understanding is therefore kindly requested, recognising that we will do our utmost to get the item(s) dispatched promptly.

Orders over $50 will be sent by Signed For and/or Tracked Mail (recognising that again different carriers operate different conditions on International Mail).

COMMISSIONS

Kate has worked on many Commissions over the years, many of which you may see here on this site, or on Scanart Gallery (scanartgallery.com) or on her facebook page Kate Daniels Art.

Part of what make the difference between a good painting and a great painting are seemingly little (but important) things. Having a good photo to work from - or if there are some particular features / markings / coloration that are unique to the subject - multiple photos is an important issue.

​

Creating these works of art remotely, Kate does not have the luxury of seeing the subject close up, and works solely on the details she can see on the photo. For this reason it is highly recommended that you send a good quality photo and supplement this with information about particular markings etc.

If you look at Kate's previous commissions you will see the level of detail she works with, and therefore the level of detail that she will need about the subject.

​

Commissions for Watercolors typically take 1-2 weeks, but do need to be scheduled into her demanding schedule. Oil Commissions take longer as the drying time for oil is much longer.

 

Timescales will be discussed with the purchaser at the time of making the order.

COPYRIGHT

Copyright is an important matter in the art and design world. The breach of copyright can result in legal action being taken against the offender. All of Kate's work is automatically copyrighted at time of creation, and should not be copied or used without specific written permission. The same copyright laws cover the creation of photographs, and for this reason all photographs provided to Kate for the purposes of creating a painting must be accompanied by a Copyright Disclosure (which will be sent to you on confirmation of order). This confirms that the person providing the photo owns it's copyright, and for good measure restates that when a painting be made by Kate, that the copyright of that painting rests at all times with the Artist, and does not transfer with the ownership of the painting itself. By signing this disclosure you absolve the artist / Dansk Kunstdesign & Restaurering / Kate Daniels Art / Scanart Gallery of any liability under Copyright Law.
